SCOTUS has lost all credibility wit intelligent reasonable Americans. TG for Sonia Sotomayor. Roberts will not be viewed favorably by historians. For anyone who's tried to peel back the layers of the onion to understand CMS's rulemaking, obliterating the Chevron deference to agency experts and replacing it with the courts is the height of arrogance.

Thanks for the trenchant observations. Agree wholeheartedly with your concerns; to me it appears we are marching towards a 1933 moment.

I would note that the Democratic Party has failed miserably for the last 15 years in understanding what we are up against. There’s been no coherent response to the right wing’s very well planned and executed education of the masses. That and citizens united have put us here.

Doesn’t matter that you have a ‘team of rivals’ around you, you still have to make the right decisions, and Biden fails miserably. Gaza, Ukraine, China. Macron isn’t leading the French resistance to right-wingers, the French left is. Yes, SCOTUS sucks, and yes, Trump sets the lowest of low bars, but when will the Democratic Party renounce fealty to monied interest donors and get back to support for a radical, yes, I used that word, a radical transformative legislative agenda a la FDR’s Second Bill of Rights? There is nothing pragmatic about incremental solutions to catastrophic issues; climate, the threat of nuclear war, and obscene wealth inequality. We’re headed for a dark place, and Biden is pissing in the wind.

At least he's pissing in the right direction. Take a lesson from the French left: they saw the threat posed by ultraconservative rule and realized they could advance their agenda better under a milquetoast centrist. I agree on Gaza. I fail to see how Biden has not sought an acceptable middle ground in dealing with Russia's invasion of Ukraine and China's belligerence borne of growing economic and military might. BTW, FDR's Four Freedoms speech, which contained the second bill of rights, was his State of the Union address in January 1941 -- shortly after his reelection to an unprecedented third term and a year before America's entry into WWII.

I’d quibble a bit with your analysis of the French left and the comparison here in the U.S. I’m separating the left from the centrists (Biden/Macron) in both cases. The French left, while never holding power outright, has a muscular enough (strikes, mass protests at the drop of a hat) history to give the centrists pause should the centrists adopt the my way or the highway path the centrists in the U.S. hold towards the left. Macron accepted the French left’s plan to have both factions withdraw candidates in order to avoid the effects of a split vote. No way in hell the Democratic Party establishment/Biden would do that here, even if they were looking at losing. They are committed to the exclusive binary system under which they hold on to/acquire power, and they would rather lose elections than give up ideological (centrist capitalist) influence.
